Terms of Service

These terms are an agreement between you and Wiregrass Property Management LLC ("we", "us"), the owner and operator of Fence Alerter (fencealerter.com and app.fencealerter.com). By creating an account, installing the Fence Alerter client or using the service, you agree to them.

1. What the service is

Fence Alerter relays the position of your dog's tracking collar, as reported by your own Garmin handheld connected to your Windows PC, to our servers. It shows that position on a map, lets you draw a virtual fence and sends you phone calls and text messages when the position crosses that fence or when the connection is lost.

2. What the service is not

Fence Alerter is an alerting aid, not a containment system. It cannot stop, restrain, train or locate a dog on its own and it never sends any command to the collar. Alerts depend on your handheld, collar, PC, internet connection, the phone network and our servers all working at the same time, and any of them can fail. You remain fully responsible for supervising your dog. Do not rely on Fence Alerter as your only safeguard for your dog's safety or for anyone else's.

3. Your account and equipment

You must be at least 18, give accurate information, and keep your password private. You are responsible for your Garmin equipment, your PC and your internet connection. Fence Alerter is an independent product and is not affiliated with, endorsed by or sponsored by Garmin; Garmin and Alpha are trademarks of Garmin Ltd.

4. Calls and text messages

When you add a phone number you confirm you own it or have the owner's permission, and you consent to receiving automated alert calls and text messages at that number from Fence Alerter. Message and data rates may apply. You can remove a number in the portal at any time, reply STOP to any text to stop texts, or disarm the fence to stop all alerts. Alerts are not sent while your subscription is inactive or the fence is disarmed.

5. Trial, subscription and payment

New accounts get a free 3-day trial, one per household or network. After the trial the service costs $14.99 per month or $149 per year per dog, billed in advance. You can cancel at any time; the service continues until the end of the paid period and no partial refunds are given except where the law requires.

6. Acceptable use

Use the service only with equipment you own or are allowed to use and only to monitor your own animals. Do not attempt to access other accounts, disrupt the service, or reverse engineer the client beyond what the law permits.

7. Availability and changes

We work to keep the service running around the clock but do not guarantee uninterrupted operation. We may change or discontinue features, and we will give reasonable notice of material changes to these terms by email or in the portal.

8. Disclaimer of warranties

The service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose and any warranty that alerts will be timely, accurate or delivered.

9. Limitation of liability

To the fullest extent permitted by law, Wiregrass Property Management LLC is not liable for any indirect, incidental, special or consequential damages, or for the loss of, injury to or death of any animal or person, or damage to property, arising from use of or inability to use the service, including missed, late or false alerts. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

10. Termination

You can close your account at any time by emailing us. We may suspend or close accounts that break these terms or do not pay.

11. Governing law

These terms are governed by the laws of the State of Alabama, and any dispute will be brought in the state or federal courts located in Alabama.
